Question:

104 Mr. Durkan asked the Minister for Finance when concessions under the 1994 disabled drivers regulations will be offered to a person (details supplied) in County Kildare; and if he will make a statement on the matter. [9470/00]

It is a fundamental requirement for relief under the Disabled Drivers and Disabled Passengers (Tax Concessions) Regulations, 1994, that the disabled person meets the medical criteria specified in the regulations and is in possession of a primary medical certificate to that effect issued by the appropriate senior area medical officer, who is an employee of the local health board. In cases where the issue of the primary medical certificate is refused on the basis that the medical criteria are not met, it is open to the applicant to appeal this refusal to the disabled drivers medical board of appeal, an independent body, whose decision is final.

I understand the issue of the necessary certificate was refused in this case and that this refusal was appealed to the board of appeal. The person concerned was assessed by the board on 3 December 1999 and was found not to meet the medical criteria for the relief at that time.
