Question:

62 Mr. Kenny asked the Tánaiste and Minister for Enterprise, Trade and Employment if her attention has been drawn to the release of a number of new films (details supplied) which are not available in video outlets generally and are only distributed by particular outlets on the basis of exclusive deals; if she considers this is in accordance with best practice and competition; and if she will make a statement on the matter. The Competition Acts, 1991 to 1996, apply to all areas of the econ omy. The Competition Authority is responsible for the enforcement of the Acts.

Allegations of any practices pertaining to any sector, product or service, including films, which are contrary to competition law, may now be pursued in one of two alternative ways; a person alleging anti-competitive activity within the terms of the Competition Acts may himself take civil action under section 6 of the Competition Act, 1991, or, make a complaint to the Director of Competition Enforcement requesting him to investigate the alleged breach(es). The post of Director of Competition Enforcement in the Competition Authority was created by law and appointed in order to give effect to the public enforcement provisions of the Competition (Amendment) Act, 1996.

I have brought the Deputy's question to the attention of the Competition Authority.
