118 Mr. Hogan asked the Tánaiste and Minister for Enterprise, Trade and Employment if her attention has been drawn to the unfair competition and loss of revenue being experienced by some tractor importers due to the presence of the grey market; the plans she has to deal with this problem in a regulatory manner; and if she will make a statement on the matter. I have not received any complaints regarding the importation of tractors on the grey market. This market, sometimes known as parallel trade, refers to the buying and selling of goods outside the usual channels of distribution.

I am informed that the Competition Authority has not received any complaints relating breaches of competition law in this regard.

If the Deputy is aware of anti-competitive behaviour in this, or any other sector he should bring the specifics to the attention of the Competition Authority if such anti-competitive behaviour is taking place in the State. If, however, such behaviour is taking place between member states of the EU any complaints should be made to the directorate general for competition at the European Commission.
I understand from my colleague, the Minister for Finance, that the Revenue Commissioners are investigating VAT issues in relation to this matter and he will be in contact with the Deputy.
