291 Mr. Haughey asked the Minister for Justice, Equality and Law Reform if the Garda in Dublin have a policy of not responding to telephone complaints about noisy neighbours playing loud music late at night; and if he will make a statement on the matter. [13513/00]

I am assured by the Garda authorities that the Garda Síochána in Dublin does not have such a policy as referred to by the Deputy. I should point out, however, that when gardaí receive a complaint about neighbours playing loud music at night, they can request the occupants of the house complained of to lower the noise levels. The Garda powers in this regard relate to ensuring that a breach of the peace does not occur. Complainants may be advised by the Garda of their civil entitlements under section 108 of the Environmental Protection Agency Act, 1992.
