Question:

294 Mr. Neville asked the Minister for Justice, Equality and Law Reform the reason it is the policy of the Garda Síochána to enforce custody orders for children but not access orders. [14305/00]

I understand from the Garda authorities that child custody and access orders are issued by the civil courts. I am informed that the Garda Síochána has an enforcement role in respect of such orders only as directed by the courts. I am further informed by the Garda authorities that non-compliance with an order is usually brought to the attention of the courts by the aggrieved party and, subsequently, should the court impose a fine or imprisonment, the warrant is transmitted to the gardaí for execution.

If the Deputy is concerned with any particular case he should bring it to my attention I will have it looked into.
