252 Mr. McGuinness asked the Minister for the Environment and Local Government if he will have considerations made into introducing a scale of compensation which ensures that farm owners or other property owners whose property is subject to compulsory purchase orders for road building purposes, will not only be given the commercial value of the land subject to CPO, but also an additional sum based on factors such as disturbance, noise and the division of farms; and if he will make a statement on the matter. The existing compensation code provides for the determination by a property arbitrator, in default of agreement between the local authority and the landowner, of the appropriate compensation based on the market value of the land and other sums for disturbance, severance and injurious affection as outlined in the relevant compulsory acquisition compensation code. In the circumstances, I have no proposals to change this system.
