Question:

147 Mr. Cosgrave asked the Minister for the Environment and Local Government if, in view of the confirmation of the special area amenity order for Howth, he will outline the conditions made by him as attached to the order; and if he will make a statement on the matter. [15830/00]

On 16 May, 2000, I made an order confirming, subject to minor modification, the Fingal County Council – Howth – Special Amenity Area Order, 1999. The modification provides for the exclusion of the East Pier from the area covered by the council's order. There are no conditions attached to the ministerial order. However, as required under section 43(4) of the Local Government (Planning and Development) Act, 1963, the order has been laid before both Houses of the Oireachtas. If a resolution annulling the order is passed by either House within 21 sitting days, the order shall be annulled.

A copy of the Fingal County Council (Howth) Special Amenity Area Order, 1999, which details the area covered by the order and the objective of the planning authority in relation to that area, is available in the Oireachtas Library.
