Michael Creed

Question:

127 Mr. Creed asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Cork, who changed his system of farming from dairy to beef production in April 2000, will be entitled to area based payments such as beef premiums and extensification as he has not submitted a current area aid application and in view of the fact that as he was involved solely in dairying up to now he was exempted from so doing; and if he will make a statement on the matter. If the person named has not submitted a 2000 area aid application, he would be entitled to payment of premium only on up to a total of 15 reckonable livestock units under the suckler cow premium and-or special beef premium schemes, having first taken into account the reckonable livestock unit value of any ewes applied for under the 2000 ewe premium scheme and any milk quota held at 31 March 2000-1 April 2000, whichever date is appropriate in this case.

The person named will not be entitled to disadvantaged area headage payments or extensification premium payments in 2000.

Willie Penrose

Question:

128 Mr. Penrose asked the Minister for Agriculture, Food and Rural Development the reason a 1999 beef cow subsidy payment has not been made to a person (details supplied) in County Westmeath who applied upon advice in October 1999; if he will have this application reviewed; and if he will make a statement on the matter. [16361/00]

My Department has no record of having received a 1999 beef cow headage scheme application from the person named at any time in 1999. He is not, therefore, entitled to any grants under that scheme.

As the person named had submitted applications under the beef cow scheme during May of previous years he would have automatically received the 1999 beef cow scheme application form in the post by the end of April, 1999. The helpsheet for applicants, which accompanied the application form and the terms and conditions of the 1999 beef cow scheme, states that there "is only one application period, – 4 May to 31 May – for cattle-beef cow headage". Clause 18 of the terms and conditions sets out details of the actual closing date of the scheme as well as the extended closing date for receipt of the application to which late application penalties apply. The closing date for receipt of applications under the 1999 beef cow scheme was extended to 4 June 1999 and notification of this extension was placed by my Department in all daily and local newspapers as well as local radio.

The onus is on the applicant to submit an application form for any of the headage and premia schemes on time and there is no evidence on file to suggest that my Department advised him to submit his application under the 1999 beef cow scheme in October 1999.

John V. Farrelly

Question:

129 Mr. Farrelly asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Meath is being refused a subsidy since 1998; the further reason his application under the hardship fund, due to his herd being locked up, was also refused; when this matter will be dealt with; and if he will make a statement on the matter. [16362/00]

The holding of the person concerned was derestricted following the first full herd retest on 2 March 1998. An essential prerequisite for eligibility for hardship grant is that the holding of the herdowner applying must continue to be restricted following a full herd retest. In the circumstances, the person concerned was ineligible for a hardship grant.
