191 Mr. G. Mitchell asked the Minister for Health and Children if he will accept the recommendation of the Oireachtas Committee on Health and Children that the statute of limitations not be applied in the case of those who pursue the tobacco industry such as a person (details supplied) in Dublin 12. 196 Mr. Haughey asked the Minister for Health and Children if he has given any consideration to extending the limitation period with regard to the taking of legal action against the tobacco companies as raised in the report of the Joint Oireachtas Committee on Health and Children published in October 1999; and if he will make a statement on the matter. I propose to take Questions Nos. 191 and 196 together.

I have not reached any conclusions with regard to the recommendation regarding the Statute of Limitations contained in the Joint Oireachtas Committee on Health and Children report on smoking. I am advised that there are possible legal and constitutional implications with regard to any alteration to the Statute of Limitations 1957 and 1991.
