Question:

159 Caoimhghin Ó Caoláin asked the Tánaiste and Minister for Enterprise, Trade and Employment if any further representations or actions have been taken by her Department in the case of a person (details supplied) in County Cavan who won an award for unfair dismissal and has yet to be compensated. [25914/00]

The reply which I gave to the earlier question on 8 February 2000 last indicated the general background of this case and the action my Department had taken to secure a positive outcome for the award in question of the Employment Appeals Tribunal. That reply further indicated that there were certain difficulties concerning the viability of further legal action by me on behalf of the employee which I was having assessed.

I have now been advised by my legal advisers that, since there is no reasonable prospect of success in the case, it would not be appropriate for me to further pursue the enforcement of the determination of the tribunal. The employee in question has been advised to this effect and of the other possible courses of legal action which she can pursue in her private capacity.
