Written Answers. - Social Welfare Appeals.

Question:

316 Mr. Ring asked the Minister for Social, Community and Family Affairs when an unemployment benefit appeal for a person (details supplied) in County Mayo will be finalised. [26400/00]

The person concerned is employed as a part-time chef. Her application for unemployment benefit was considered by a deciding officer who was of the opinion that she was not available for suitable full-time employment. Her claim was disallowed accordingly on 12 October 2000.

The person has now appealed this decision to the social welfare appeals office and her appeal will be referred for consideration by an appeals officer.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.

317 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal for a person (details supplied) in County Mayo will be finalised. [26402/00]

The person concerned was paid unemployment assistance from April 1999 on the basis of a nil means assessment as she had stated at interview that she had no capital or property. Following a review of the case in May 2000, the deciding officer considered that the person concerned had failed to disclose means and her claim was disallowed.

The person concerned appealed this decision to the social welfare appeals office. Her appeal has been considered by an appeals officer who is of the opinion that an oral hearing is necessary. This will be arranged as soon as possible.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
