Question:

360 Mr. Wall asked the Minister for Justice, Equality and Law Reform if he will consider introducing legislation to ensure that property owners can obtain court orders at District Courts to prevent persons illegally parking on properties and to prevent persons seeking money from property owners to vacate their property rather than having to pay the cost of a higher court action; and if he will make a statement on the matter. The law provides, by way of section 17 of the Criminal Justice (Public Order) Act, 1994, for the criminal offence of demanding money with menaces. The Deputy specifies the circumstance where a person seeks money from a property owner to vacate his or her property and I am asking the Garda authorities for a report on this practice and, in particular, on the question of the application in these cases of section 17 of the Act of 1994. I have no proposals to extend to the District Court the special jurisdiction which the High and Circuit Courts have to injunct persons from certain courses of action.
