40 Mr. Gilmore asked the Minister for the Marine and Natural Resources if he will meet the Killiney Beach Awareness Group to discuss the work being carried out on Killiney Beach, County Dublin, by Iarnród Éireann; and if he will make a statement on the matter. [3359/01]

42 Mr. Gilmore asked the Minister for the Marine and Natural Resources the outcome of his consultations with the Chief State Solicitor's office regarding Iarnród Éireann's work at Killiney Beach, County Dublin; if he will seek an injunction to halt unauthorised work being carried out by Iarnród Éireann; if he will prosecute Iarnród Éireann for carrying out this work; and if he will make a statement on the matter. 61 Mr. Andrews asked the Minister for the Marine and Natural Resources the action he is taking in relation to the requirement for a foreshore licence for works carried out by Iarnród Éireann on Killiney Beach, County Dublin; and if he will make a statement on the matter. [3504/01]

I propose to take Questions Nos. 40, 42 and 61 together.

Consultations with the Office of the Chief State Solicitor are ongoing. The Chief State Solicitor has sought the advice of both the Attorney General's office and counsel on the issue and it would be improper of me to prejudge the advice I will receive on this matter. All possibilities, including injunctive action, will be examined. I met the Killiney Beach Awareness Group yesterday evening and noted its concerns. The Deputies will, however, be aware that senior officials of my Department, both administrative and technical, attended a public meeting held by the group on Wednesday, 31 January and later met local representative organisations. I have received a full report of that meeting and I am considering it.
