Question:

262 Mr. U. Burke asked the Minister for Arts, Heritage Gaeltacht and the Islands further to Parliamentary Question No. 280 of 6 March 2001, applicant names in cases where the appeal board recommended alterations to the proposed designation boundaries and where these boundaries have been altered in her submission to Europe. [10794/01]

The Deputy will be aware that it would be inappropriate to give names of individual appellants in response to the question. However, all cases where alterations were recommended by the board are listed as follows. The changes were accepted and the necessary steps taken to advise the Commission accordingly.

Question:

263 Mr. U. Burke asked the Minister for Arts, Heritage Gaeltacht and the Islands the measures which are in place to compensate commercial property landowners where their lands are included in lists of proposed special areas of conservation sites. [10795/01]

Compensation is available for losses of income or costs incurred by landowners as a result of restrictions arising from the designation of their lands as part of a special area of conservation. The compensation provisions cover actual losses but not perceived losses of potential income. They cover restrictions on existing commercial activities and are not confined to agricultural land uses. The compensation provisions, as they relate to agriculture, require EU approval as a State aid. A scheme has been submitted to the EU Commission and I expect formal approval in the near future.
