Question:

558 Mr. Durkan asked the Minister for Justice, Equality and Law Reform if he will accede to the transfer to open prison request by a person (details supplied) now serving a two years sentence in Mountjoy Prison, Dublin 1; and if he will make a statement on the matter. [12397/01]

The person referred to was sentenced to two years' imprisonment on 10 November 2000 for assault occasioning actual bodily harm. He received an additional six month sentence on 28 November 2000 for damaging property intending to endanger life. With standard remission he is due for release on 10 May 2002. I have given this case careful consideration but I am not prepared to approve a transfer to an open centre at this early stage of his sentence. However, this case will remain under review.
