143 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 362 of 3 April 2001, he will confirm that the Garda authorities made the list of recommendations arising from the investigation referred to available to him; if without reference to evidence gathered, he will detail the recommendations contained therein; and the measures taken to ensure that these recommendations are acted on. 145 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 66 of 5 October 2000, the Garda authorities made the list of recommendations arising from the investigation of the Assistant Garda Commissioner on the veracity of the statements of admission available to him; if he will list the recommendations therein without reference to evidence gathered; and the measures taken to implement the recommendations. [13340/01]

I propose to take Questions Nos. 143 to 145, inclusive, together.

As the Deputy is aware, it is not Ministers' practice to comment on individual Garda investigations, save in the most exceptional of circumstances. Furthermore, as the Deputy will be aware, the Garda Commissioner is independent in the exercise of operational functions. Garda investigations are not carried out under the aegis of my Department or any other Department of State. Files on the matters to which the Deputy refers were forwarded to the Director of Public Prosecutions for consideration.

No list of the kind referred to by the Deputy has been made available to me. I can confirm, however, that the Garda authorities have assured me that the two persons in question were lawfully arrested and lawfully detained.
