382 Mr. Bell asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to the fact that the Maltese ship, Arachovitika Bay, was sold by court order due to non-payment of the Pakistani crew's wages of £90,000; if his attention has further been drawn to the fact that the cost incurred from the sale was £30,000, the bulk of which was a court fee of 10%; if, under the circumstances, he will waive the fees involved; and if he will make a statement on the matter. Question:

384 Mr. O'Shea asked the Minister for Justice, Equality and Law Reform the proposals he has to allow courts to waive court charges in certain exceptional circumstances regarding marine disputes over non-payment of wages (details supplied); and if he will make a statement on the matter. [14388/01]

I propose to take Questions Nos. 382 and 384 together.

I understand that court fees were charged in this case pursuant to the Supreme Court and High Court (Fees) Order, 1989 (S.I. No. 341 of 1989). The court fees orders are made by myself as Minister for Justice, Equality and Law Reform with the consent of the Minister for Finance. The relevant fees are payable to the court and the moneys collected are credited directly to the Exchequer. There is no provision for waiving such fees.
