124 Mr. P. Carey asked the Tánaiste and Minister for Enterprise, Trade and Employment if, in view of the fact that payments due under the Minimum Notice and Terms of Employment Acts, 1973-1991, have not been paid to a person (details supplied) in Dublin 11, she is in a position to ensure that these payments are made without further delay; and if she will make a statement on the matter. The case under reference was the subject of a determination of the Employment Appeals Tribunal last year in which the tribunal made an award to the employee in question under the Minimum Notice and Terms of Employment Acts, 1973 to 1991.

Representations were made to my Department advising of non-payment to the employee concerned of the tribunal award. My Department followed up on these representations requesting payment to the employee of the amount due by the employer. The employee concerned subsequently advised my Department that payment of the award had not been received.

A file in the matter has now been prepared and passed to my legal advisors, i.e. to the Chief State Solicitor's office for legal advice as to the enforceability of the determination and, if so enforceable, for their consideration as to the appropriate legal steps to take to enforce the award. As such steps may ultimately entail prosecution of the individual's former employer in the courts, it has been necessary, as part of the general preparatory work for a possible hearing, to carry out a check as to the precise legal identity of that employer with a view to ensuring legal enforceability of the tribunal determination.

As soon as legal advice is received officials of my Department will be in direct contact with the individual concerned.
