Question:

478 Ms O'Sullivan asked the Minister for Justice, Equality and Law Reform when three persons (details supplied) of Romanian origin will have their residency papers processed; and if he will make a statement on the matter. [16761/01]

The three persons in question have made separate applications for permission to remain in the State based on their parentage of Irish born children.

The first named person's application was received in December 2000 and has not been finalised. The person in question has returned to his home country and will require a visa to re-enter the State. In the event that a visa application is made, consideration will be given to the person's admission in advance of the finalisation of his application for permission to remain.

The second named person applied for permission to remain as the parent of an Irish citizen in January 2001 and his application is also outstanding. I understand that the Dublin Convention section of the Office of the Refugee Applications Commissioner is currently considering a request from the UK authorities for the person's return under the Dublin Convention.

The last named person was issued with a letter granting him permission to remain in the State in April 2001. It would appear, however, that the person had left the State and entered the UK illegally before receiving this letter. At this time I am not aware of any Dublin Convention or other application from the UK authorities for the return of a person of this name.
