Question:

259 Mr. Hayes asked the Minister for the Environment and Local Government if he has satisfied himself with the existing tenancy agreements that are in place between council or corporation tenants and the local authority; his views on whether there is enough emphasis placed in such agreements on the need for tenants to maintain and keep in good condition the existing housing stock and other related matters of tenant responsibility and if he will make a statement on the matter. The conditions which govern the letting of a dwelling by a local authority are set out in broad terms in Article 83 of the Housing Regulations, 1980, including a requirement that the tenant shall not cause any damage to the house and shall keep it in a clean and proper state, and shall not allow any refuse or offensive matter to accumulate in any portion of it.

It is a matter for the local authority to ensure their tenancy agreements clearly indicate the respective responsibilities of the tenant and the local authority in relation to the upkeep and maintenance of the dwelling and that the terms of the agreements are complied with. I am satisfied that local authorities have adequate legal powers to fulfil their responsibility in this area.
