156 Mr. Neville asked the Minister for Agriculture, Food and Rural Development the outcome of the decision of the appeals committee on the refusal to make a REP scheme payment in 1998 to a person (details supplied) in County Limerick. [18766/01]

Appeals against penalties applied to the fourth and fifth year REPS payments of the person named have not yet been considered by the REPS appeals committee. In line with normal practice an investigation is taking place and when this is completed a report will be submitted to the appeals committee where the entire matter will be fully considered. When the committee takes its final decision the person named will be informed directly in writing.

157 Mr. Ellis asked the Minister for Agriculture, Food and Rural Development if he will now make a payment of a 2000 extensification premium to a person (details supplied) in County Leitrim. [18767/01]

The person named cannot be considered for payment of extensification premium until he returns his CEN.2 Form to my Department on which he was requested to declare the numbers of bovine animals over the age of six months on his holding at the fourth and fifth census dates of Sunday, 24 September and Sunday, 19 November 2000. Provided he returns the CEN.2 form immediately, his eligibility for the premium will be assessed.

The procedures for processing applications under the scheme of investment aid for farm waste management are under discussion with the union concerned. Applications will be processed and approval to commence works will issue as soon as the procedures are finally agreed. I am keeping this matter under constant review.
