Question:

104 Ms McManus asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has received any indication from the Health and Safety Authority on the enforcement action it plans to take arising from its investigation into the death of a man in an industrial accident (details supplied); and if she will make a statement on the matter. [23198/01]

The National Authority for Occupational Safety and Health – known as the Health and Safety Authority – is the State body with responsibility for the administration, monitoring and enforcement of occupational health and safety legislation. The carrying out of inspections and investigations is a day-to-day matter for the authority, as is the taking of enforcement action, in which I have no statutory function.

I have, however, been informed by the authority that it has completed its investigation into the industrial accident referred to by the Deputy, and a file on the matter has been sent to the Office of the Director of Public Prosecutions.

In this regard, it would be inappropriate for me to comment further on this matter as it could prejudice any subsequent action that might ensue.
