Question:

243 Mr. Sheehan asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Cork did not receive an additional payment under the REP scheme for mountain walks for the years 1998/1999 and 1999/2000. [23928/01]

The person named commenced in REPS on 1 August 1997. Complete documentation relating to supplementary measure 5 of the scheme, public access and leisure activities, was not made available by the person named to my Department's local farm development service office until 10 November 1999. It was only from that date that the application under the supplementary measure could be considered. The supplementary measure was paid to the applicant with his fourth-year and fifth-year payments under the scheme.

244 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive an area-based payment. [23929/01]

The 2001 area aid application of the person named has now been fully processed and payment of her full entitlement under the 2001 area-based compensatory allowance scheme will issue before the end of October 2001.

245 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive an area-based payment. [23930/01]

A condition of the area-based compensatory allowance scheme is that applicants must meet a minimum stocking level of 0.15 livestock units per forage hectare in the year preceding application. The stocking density of the person named was 0.08 livestock units per forage hectare in 2000. However, farmers who are unable to meet the minimum stocking density but who traditionally qualified for headage grants in respect of cattle and-or sheep may continue to qualify for payment, provided their land is being utilised and is not in danger of undergrazing. The application of the person named has been cleared and payment will issue before the end of October.

246 Mr. M. Moynihan asked the Minister for Agriculture, Food and Rural Development when a control of farmyard pollution grant will be paid to a person (details supplied) in County Cork. [23931/01]

The national scheme for the control of farm pollution, now replaced by the new farm waste management scheme, was extremely successful and uptake exceeded all expectations. The EU-imposed ceiling for expenditure under this scheme has been reached and my Department has applied to the European Commission to formally raise the ceiling. A number of payments under the scheme, including payment to the person mentioned in the question, has been delayed pending receipt of this formal approval. Following recent discussions between my Department and the European Commission a positive response is expected very shortly. All payments will issue immediately approval is received.

248 Mr. Higgins (Mayo) asked the Minister for Agriculture, Food and Rural Development the reason for the delay in forwarding an area aid payment and a suckler cow payment to a person (details supplied) in County Mayo. [23933/01]

The person named included 17.34 hectares in his 2001 area aid application. An area of 16.97 hectares was determined which is some 0.37 hectares or 2.18% less than the area claimed. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no area aid penalty is applied, leaving the area determined for payment purposes at 16.97 hectares. Payment of his full entitlement under the 2001 area-based compensatory allowance scheme and the 80% advance under the 2001 suckler cow premium scheme will issue to the person named before the end of October 2001.

249 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when area aid payments will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [23934/01]

The person named was not a headage recipient in 2000, and according to my Department's records, the stocking density of the holding does not meet the minimum stocking density. My Department will be in contact with the person named shortly with a view to establishing the type of farming activity being pursued. A decision on entitlement to area-based compensatory allowance will then be made.
