Vol. 542 No. 2

Written Answers. - Pension Provisions.

Pat Rabbitte

Question:

282 Mr. Rabbitte asked the Minister for Health and Children if he will allow persons in receipt of superannuation governed by his Department, especially those workers who have had to retire early on health grounds, take up part-time non-physical taxable employment; the reason rules prevent workers physically unable to cope but otherwise capable of mental work from any kind of employment; and if he will make a statement on the matter. [23764/01]

I understand there is nothing to preclude a person in receipt of a pension paid by a scheme governed by my Department from taking up other employment. In certain circumstances, persons in receipt of a pension under these schemes may have the pension abated if they become re-employed by a body to which these schemes apply. Where a person retires prematurely on grounds of permanent infirmity, the person shall satisfy the Minister that the incapacity continues and, for that reason, may be required to submit themselves to medical examination at any time up to normal retiring age.
