106 Mr. Crawford asked the Minister for Agriculture, Food and Rural Development when persons (details supplied) in County Monaghan will receive a headage payment and other livestock related payments; and if he will make a statement on the matter. [24378/01]

The persons named are not applicants under the 2001 ewe premium scheme or the 2001 special beef premium scheme. They will be paid their full entitlement under the 2001 area based compensatory allowance scheme and their 80% entitlement under the 2001 suckler cow premium scheme before the end of October 2001.

116 Mr. Higgins (Mayo) asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo has not received premium for ewes or the £70 per hectare payment for 2001. [24504/01]

I propose to take Questions Nos. 107 and 116 together.

In regard to the 2000 ewe premium-rural world premium scheme, the position is that all payments under the ewe premium, as stated in my reply to Parliamentary Question No. 301 of 3 October, were made to the person named in two instalments in June 2000 and February 2001. As there is no record of receipt in my Department of an area aid application for that year nor a certificate of posting for same he did not qualify for payment of the rural world premium.

The position in regard to the 2001 ewe premium-rural world premium is that he applied on 60 ewes and was paid the first instalment on these ewes on 2 August last. Payment of the second instalment together with the rural world premium will issue shortly. Payment under the 2001 area based compensatory payments scheme will issue before the end of October.

108 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when an area aid payment will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [24380/01]

A condition of the 2001 area based compensatory allowance scheme is that applicants must meet a minimum stocking level of 0.15 livestock units per forage hectare in the year preceding application. However, farmers who are unable to meet that minimum stocking density but who traditionally qualified for headage grants in respect of cattle and/or sheep may continue to qualify for payment, provided their land is being utilised and is not in danger of undergrazing. The person named was not a headage recipient in 2000 and, according to my Department's records, the stocking density of the holding does not meet the minimum stocking density. My Department will be in contact with the person named shortly with a view to establishing the type of farming activity being pursued. A decision on entitlement to area based compensatory allowance will then be made.

109 Mr. Ellis asked the Minister for Agriculture, Food and Rural Development if an area based payment will be made to a person (details supplied) in County Sligo. [24381/01]

The person named included 44.33 hectares in his 2001 area aid application. An area of 43.79 hectares was determined which is some 0.54 hectares or 1.23% less than the area claimed. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no area aid penalty is applied, leaving the area determined for payment purposes at 43.79 hectares. Payment of his full entitlement under the 2001 area based compensatory allowance scheme will issue before the end of October 2001.

A herdowner must submit a valid area aid application for the relevant year in order to be considered for payment under the area based compensatory allowance scheme. No area aid application was received from the person named for the year 2001, and consequently no area based compensatory allowance payments can be made for the year in question.

The 2001 area aid application for the person named has been fully processed and payment due under the 2001 area based compensatory allowance scheme will issue before the end of October 2001.

The person named included 35.2 hectares in his 2001 area aid application. An area of 35.01 hectares was determined, which is some 0.19 hectares or 0.54% less than the area claimed. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no area aid penalty is applied, leaving the area determined for payment purposes at 35.01 hectares. Payment of his full entitlement under the 2001 area based compensatory allowance scheme will issue to the person named before the end of October 2001.
