Question:

231 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when an area based payment will be received by a person (details supplied) in County Mayo. [26033/01]

The 2001 area aid application for the person named has been fully processed and any payments due under the 2001 area-based compensatory allowance scheme will issue shortly.

Question:

232 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development the position in relation to the recouping of moneys in respect of a person (details supplied) in County Tipperary. [26034/01]

The area aid application relating to this herd number was subject to an inspection in 1998 in which an overclaim of some 28% was determined. Under Article 9 of EU Regulation 3887/92 when the difference is over 20%, a 100% penalty must be applied. Therefore in this case, as the overclaim was greater than 20%, any area aid linked payments issued in respect of 1998 must be recovered.

The amounts paid under 1998 schemes were £2,804.60 in respect of suckler cow premium, £862.60 in respect of extensification premium and £2,133 in respect of cattle headage-beef cow. The amounts of £2,804.60 and £862.60 have been recovered from recent scheme payments but £2,133 is still outstanding and will be recovered from future payments.
The bulk of this area aid overclaim was caused by the fact that the applicant who is now deceased applied for area aid in respect of a commonage parcel but failed to provide proof of his entitlement to this commonage. However in the event that the person named feels that a review of this case is now justifiable and if she provides supporting documentation, I would be prepared to have the matter re-examined.
