Question:

522 Mr. Sargent asked the Minister for the Environment and Local Government if it will be permissible to grant planning permission in future in advance of an EPA licence being granted; and if damage to the health of a local community or the environment is likely to occur as a result of a development. [26730/01]

In the case of a development which requires both planning permission and an integrated pollution control licence, the law does not require that an integrated pollution control licence be granted in advance of planning permission being sought. However, both must be obtained before such activity can lawfully begin.

The impact of a development on the environment and the surrounding community is a matter for the local authority when considering applications for planning permission and the Environmental Protection Agency when considering an application for an IPC licence, as appropriate.
