Question:

184 Mr. Howlin asked the Minister for Justice, Equality and Law Reform the basis on which a person (details supplied) in County Wexford who married a United Kingdom national in December 2000 has been denied entitlement to reside here; and if he will make a statement on the matter. [27124/01]

The person in question was recently informed that his application for permission to remain as the spouse of an EU national exercising a right under the EU treaty to reside in the State had been refused as his spouse, although present in the State, is not economically active, is dependant on public funds and is not otherwise exercising an EU right to reside in the State. The applicant has been invited to write to the Department setting out whether there are other grounds upon which he wishes to seek permission to remain in the State. My Department has not yet received a response to that letter.
