Question:

172 Mr. D. Carey asked the Tánaiste and Minister for Enterprise, Trade and Employment if she will request the company law enforcement section of her Department to supervise the finalisation of a company (details supplied) which went into voluntary liquidation. [28987/01]

The Companies Acts set out the procedures that a liquidator must follow in the conduct of a liquidation, including the filing of regular reports with the Companies Registration Office. The Minister for Enterprise, Trade and Employment has no direct function or role, in the conduct of any specific liquidation.

Under the recently enacted Company Law Enforcement Act, 2001, the director of corporate enforcement is given the power to exercise, in so far as the director feels it necessary or appropriate, a supervisory role over the activity of liquidators, in the discharge of their functions, under the Companies Acts. The director will also be empowered to examine a liquidator's books, in order to assess how the liquidator is carrying out his or her functions, in respect of any particular liquidation. This latter provision has not yet been commenced.
