Question:

161 Mr. Spring asked the Minister for Justice, Equality and Law Reform when he will reply to correspondence from a person (details supplied) in County Kerry. [29368/01]

My Department will shortly reply to the correspondence in question.

The person in question is travelling on a US passport and in the absence of any evidence to the contrary was therefore assumed to be a US national. US nationals, in common with all non-EEA nationals – the EEA is comprised of the member states of the EU plus Iceland, Liechtenstein and Norway – require the permission of the Minister for Justice, Equality and Law Reform to remain in the State. They are also required to register with their local Garda registration office if they intend to reside in the State for more than three months. Accordingly, once my Department has returned the passport of the person in question, she should contact the Garda superintendent's office for the area in which she resides and make arrangements to register there. Consideration can then be given to her particular circumstances and to the type and duration of permission to remain which may be granted to her. If the person in question has any documentation indicating that she is in fact an EEA national she should also present this to the registration office for consideration.
