Question:

280 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development the position regarding an appeal submitted by a person (details supplied) in County Cork; and when the appeal will be finalised. [1415/02]

On 20 April 2001 the person named applied for premium for ten cows under the 2001 suckler cow premium scheme. Correspondence issued to him on 20 June 2001 advising him that the first date by which he could sell animals without having replacements would be 21 October 2001. Further correspondence issued on 7 December 2001 informing the person named that animal tag number MPA152112 was rejected with penalty as it was sold on 5 October 2001 and was not replaced as required under the terms and conditions of the scheme.

The herdowner informed the district livestock office of my Department that he wished to appeal this decision. He was informed on 21 December 2001 to forward his grounds for appeal and his case would then be reviewed. His appeal will be considered further when these details become available.
