Question:

941 Mr. Wall asked the Minister for Justice, Equality and Law Reform the status of an application by a person (details supplied) to remain here; and if he will make a statement on the matter. [1493/02]

The person in question arrived in the State on 2 February 2000 with her son and sought asylum. On examination by the Refugee Applications Commissioner, her case was deemed to be manifestly unfounded and she was notified of this decision on 9 June 2000. She appealed this decision and her appeal was refused by the Refugee Appeals Tribunal on 29 June 2000. An application for leave to remain was submitted by the person's legal representatives on 17 August 2000.

The person in question was again informed on 23 November 2001 that it was proposed to make deportation orders in her case and that of her son. She was given the alternatives of either making representations within 15 working days setting out reasons why they should be allowed to remain temporarily in the State, leaving the State before the Minister decides whether or not to order their deportation, or consenting to the making of deportation orders. Extensive representations were received in response to the correspondence of 23 November. The case file was very recently submitted to me for consideration and I have made a decision which is in the process of being communicated to the person in question.
