Vol. 548 No. 2

Written Answers. - Registration of Title.

Michael Ring

Question:

366 Mr. Ring asked the Minister for Justice, Equality and Law Reform if he will instruct the Land Registry to expedite a dealing for persons (details supplied) in County Mayo; when this dealing will be completed; and the progress which has been made since his reply to Question No. 338 of 11 December 2001. [4549/02]

I am informed by the Registrar of Titles that this application under section 49 of the Registration of Title Act, 1964, that is, acquisition of title by virtue of long possession, which was lodged on 12 October 2001, is being examined and correspondence with the lodging solicitors will commence shortly.

I understand that, due to their complicated nature, applications under Section 49, which require detailed examination of claims for registration as owners, can take some time to process. Accordingly, it is not possible to estimate a completion date at this stage. However, I assure the Deputy that the matter will be completed as soon as possible.

Jimmy Deenihan

I am informed by the Registrar of Titles that this dealing refers to an application for registration which was lodged on 25 March 1999 by Kerry County Council. It relates to the vesting by the council of property pursuant to Section 90 of the Housing Act, 1966. Dealing number D1999DSO01364B refers.

I am further informed that a number of queries have issued to the solicitors for Kerry County Council, the latest on 20 June 2001, and the registration cannot proceed until these queries have been satisfactorily resolved. However, I assure the Deputy that, on receipt of a satisfactory reply, the matter will receive further attention in the Land Registry.

Michael Creed

Question:

368 Mr. Creed asked the Minister for Justice, Equality and Law Reform if he will arrange to have a dealing number expedited for a person (details supplied). [4601/02]

I am informed by the Registrar of Titles that this application refers to a transfer of part-voluntary, a transfer under the Family Home Protection Act, three discharges and a copy folio-filed plan which were lodged on 24 January 2002.

I am further informed that a query issued to the lodging solicitors on 8 February 2002 and that the application cannot proceed until this query has been satisfactorily resolved. However, I assure the Deputy that the matter will be dealt with as soon as possible after a satisfactory reply has been received.
