Question:

197 Mr. G. Reynolds asked the Minister for Arts, Heritage Gaeltacht and the Islands the reason a person (details supplied) in County Leitrim has not received compensation payment for works carried out on behalf of the Office of Public Works during construction of the Shannon-Erne Waterway. [5947/02]

The issue raised by the Deputy is the responsibility of Waterways Ireland, one of the six North-South implementation bodies established on 2 December 1999 on foot of the British-Irish Agreement and the supplementary Implementation Bodies Agreement signed in March 1999.

I am informed by Waterways Ireland that a payable order dated 19 December 2000 was issued to the person – referred to by the Deputy – being the agreed amount plus interest, for the acquisition of 0.313 acres of land in relation to the reconstruction of the Ballinamore and Ballyconnell Canal, now known as the Shannon-Erne Waterway.

This payable order was returned in May 2001 as the person disagreed with the interest rate applied. Since that time her solicitor and the Chief State Solicitor's Office, acting for Waterways Ireland, have been in correspondence regarding this issue. Waterways Ireland advise me that they are endeavouring to bring this case to a successful conclusion at the earliest possible date.
