Question:

81 Mr. Quinn asked the Minister for the Marine and Natural Resources the directives issued under the treaties establishing the European Communities any provision of which comes under the auspices of his Department which have not yet been transposed into law; if such transposition will be effected by Bill or statutory instrument; if transposition is overdue; if so, the steps taken by the European Commission by way of enforcement in each case; and if he will make a statement on the matter. Details of EU directives which have not as yet been transposed into law by my Department are set out in the following table. It is intended that each of the directives in question will be transposed into domestic law by statutory instrument.

Details

Present Position

Directive 96/43/EC on the imposition of Veterinary Inspection Fees for the inspection of food producing premises, inspection of food imports and border inspection.

Implementation was due by 1 July 1999. Transposition will be completed in 2002. The European Commission has been in correspondence with the Department on the question of transposition and will be kept advised of progress.

Directive 98/30/EC of the European Parliament and of the Council concerning common rules for the internal market in Natural Gas.

Implementation was due by 10 August 2000. Transposition is expected to be effected in March 2002. There has been no action by the European Commission.

Directive 99/105/EC on the marketing of forest reproductive material.

Implementation required by 1 January 2003.

Directive 2000/59/EC of the European Parliament and of the Council of 27 November 2000 on port reception facilities for ship-generated waste and cargo residues.

Transposition due by 28 December 2002.
