278 Mr. Allen asked the Minister for Health and Children if he has received a warning from St. James's Hospital that the vagueness or ambivalence of the corporate body status of health agencies is now legally dangerous and untenable; and if he will make a statement on the matter. [7718/02]

St. James's Hospital made a comprehensive submission to me as part of the consultation process associated with the preparation of the new health strategy Quality and Fairness – A Health System for You. The submission which was wide ranging in content included a brief commentary on governance, management and clinical accountability matters emerging in the context of emerging case and statue law.

The issues raised by the hospital will be examined in the context of the independent audit of functions and structures in the health system which I intend to commission in accordance with the commitment in the health strategy.
