Question:

387 Mr. Ring asked the Minister for Social, Community and Family Affairs the reason a person (details supplied) in County Mayo has not received unemployment assistance in view of the fact that this person has replied to all the questions raised by the Department and is actively, genuinely and constantly seeking work but cannot get it; and if the claim can be re-investigated in view of the fact that this person has not received a payment since October 2001. [10163/02]

The person concerned applied for unemployment assistance on 31 January 2002. A deciding officer disallowed his claim from 31 January 2002 on the grounds that he was not genuinely seeking work. It is open to the person concerned to appeal this decision and a form for this purpose is available from his social welfare local office in Ballina.

Under social welfare legislation decisions on claims and the insurability of employment must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
