Question:

541 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform if he will rescind the deportation order against a person (details supplied) on humanitarian grounds; and if he will make a statement on the matter. [11255/02]

I refer the Deputy to my reply to Question No. 436 of 26 March 2002 regarding the same person. All information on this person's file, including representations received, was considered when this person's case was assessed for leave to remain in the State. A deportation order was signed on 19 February 2002 and the person was subsequently deported to Nigeria on 13 March 2002. It is not proposed to rescind the deportation order made against this person.
