429 Mr. Ring asked the Minister for the Marine and Natural Resources the legal position with regard to the high water mark. [13474/02]

The high water mark is used, inter alia, in defining the functional areas of certain public bodies and the area of application of a number of enactments. In the case of my Department, for example, the Foreshore Acts, 1933 to 1998, define the foreshore as comprehending the bed and shore, below the line of high water of ordinary or medium tides, of the sea and of every tidal river and tidal estuary. Other statutory provisions utilising the high water mark include section 227 of the Local Government Act, 2001, which defines the maritime boundaries of local authorities' functional areas.
