Question:

120 Mr. McGuinness asked the Minister for Health and Children if, further to Parliamentary Question No. 285 of 17 April, the issues raised have been resolved with the staff members involved; if allowances which were paid to the previous holders of the positions within the nursing staff of the group homes, are now being paid to the current nursing employees; and if he will make a statement on the matter. I have been advised by the SEHB that a claim was received from the union, processed through the normal industrial relations procedures, rejected and the union responded to in that regard. Neither the union nor the individual has contacted the board further.

The previous post holder had a red circled agreement negotiated on his behalf by the Psychiatric Nurses Association. Red circled agreements do not carry forward to subsequent post holders.

The board has confirmed that the current post holder is in receipt of the correct payments applicable to the post.

Question:

121 Mr. McGuinness asked the Minister for Health and Children if, he will arrange for the SEHB to pay the cost of the treatment required in the case of a person (details supplied) in County Kilkenny; if he will reverse the decision of the board's acting chief executive officer on the basis the board and his Department failed this person. [14275/02]

The provision of services for persons living in County Kilkenny is a matter for the SEHB.

The board's acting chief executive officer wrote to the patient's family on 22 April and to the Deputy on 8 May outlining its position. Statutory responsibility in relation to this matter rests with the board. I have no role in relation to this case.
