194 Mr. Penrose asked the Minister for Finance if a river (details supplied), which has been causing problems, has been attended to; if he will ensure that this river is given immediate attention; and if he will make a statement on the matter. [14758/02]

The channel in question forms part of the Inny catchment drainage scheme, for which the Commissioners of Public Works have a maintenance responsibility under the Arterial Drainage Act, 1945. The channel was cleaned in 1999, 2000 and 2001 and further maintenance will be carried out as required.

That part of the field with which the landowner is concerned is 1.8 metres above the water level in the channel. The commissioners are satisfied they are fulfilling their maintenance responsibilities in relation to this channel. Any further land drainage of the field would be a matter for the land owner.
