288 Mr. Perry asked the Minister for Agriculture and Food when a decision will be made on a REP scheme appeal by a person (details supplied) in County Sligo; and if he will make a statement on the matter. [15945/02]

The person named was notified of proposed REPS penalties and has lodged an appeal with his local Department office. This appeal is being considered at present and a decision will be conveyed to him as soon as possible.

Should the appeal be unsuccessful, he will have the opportunity to make a further appeal to the agriculture appeals office which is statutorily independent of my Department.

A REPS penalty was imposed on the person named following an inspection by my Department. The penalty was appealed to my Department's local office and this appeal was unsuccessful. He was informed of the decision and also of his right to lodge a further appeal with the agriculture appeals office, which is statutorily independent of my Department.
