Question:

1449 Mr. Coveney asked the Minister for the Environment and Local Government if he will direct all local authorities to draw up development plans for the foreshore pertaining to their area of responsibility as obligated by the Planning Act, 2001. [15398/02]

Section 225 of the Planning and Development Act, 2000, sets out the circumstances under which planning permission is required for developments on the foreshore and provides that that part of the foreshore on which it is proposed to carry out such development is deemed to be within the functional area of the planning authority. The Act also provides in section 10 and the First Schedule that a planning authority may include objectives in its development plan regulating, restricting or controlling development on the foreshore. This provision was not designed as a mandatory requirement and accordingly I do not consider that a directive would be appropriate in relation to it.
