Question:

1458 Mr. Haughey asked the Minister for the Environment and Local Government if he has satisfied himself that adequate arrangements are in place to ensure that all those who submitted an observation to a local authority in relation to a planning application, are subsequently notified in time, by either the same local authority or by An Bord Pleanála, if an appeal is submitted to the board; and if he will make a statement on the matter. Article 69 of the Planning and Development Regulations, 2001, provides that where a copy of an appeal is sent to a planning authority by An Bord Pleanála in accordance with section 128 of the Act, the planning authority, as soon as may be after receipt of the copy of the appeal, must notify in writing any person who made a submission or observation in relation to the planning application. Consequently, any person who participated in the decision making process by the planning authority must be notified of the fact that an appeal has been made, and will be able, if they so wish, to make another submission or observation to the board in respect of the appeal. It is a matter for each planning authority to put arrangements in place to ensure that these obligations are complied with.
