Question:

58 Dr. Upton asked the Tánaiste and Minister for Enterprise, Trade and Employment the steps which have been taken to prevent a repeat of the losses to policyholders following the collapse of a company (details supplied) in 2001; and if she will make a statement on the matter. [18797/02]

The company in question is a UK authorised insurer currently in provisional liquidation. The failure of this company raises the wider issue of the treatment of EU policy holders in general in the event of the failure of a company writing cross-border business. My Department has brought this issue to the attention of the European Commission.
