Question:105 Dr. Twomey asked the Minister for Justice, Equality and Law Reform his views on the Garda Commissioner's decision to deny legal representation to members of the force who are being called by the Morris tribunal. [23632/02]

It is open to any interested party to seek representation before the Morris tribunal. The question of whether that person is granted the right to such representation is a matter for the tribunal.
My understanding of the position in relation to the Garda Síochána is that a number of members whose good name and character may be called into question have sought and have been granted the right to representation on an individual basis by the tribunal. A number of other members who were mentioned in the opening statement, but whose reputation is not being called into question have had requests for representation refused.
Counsel for the Commissioner and the Garda Síochána has indicated that it is intended to make application for legal representation on behalf of certain members, including retired members, and additional time has been granted by the tribunal for this application to be made. Such counsel has also indicated that it is not intended to apply for representation on behalf of six members and two retired members. These individuals have been advised accordingly.
