Question:

109 Mr. O'Shea asked the Minister for Justice, Equality and Law Reform the position in regard to the investigation into the serious allegations made against a number of members of the Garda in the judgment of the Court of Criminal Appeal in a case (details supplied); and if he will make a statement on the matter. [23715/02]

I am informed by the Garda authorities that an ongoing investigation is being conducted in this matter under the direction of an assistant commissioner.

Arising from the judgment delivered by the Court of Criminal Appeal which is referred to in the question, I issued a public statement on 1 August 2002, to the effect that the Garda Commissioner had, on that day, suspended two members of the Garda Síochána, a superintendent and a garda. My statement also mentioned that a third member of the Garda Síochána referred to in the judgment, a detective garda, already stood suspended. The position of the superintendent who stands suspended will be the subject of consideration by the Government.
The Deputy will understand that, in the circumstances, it would be inappropriate for me to comment further on the matter at this stage.
