179 Mr. Gregory asked the Minister for the Environment and Local Government the implications of the failure of a local authority to comply with planning regulations, that is, failure to inform objectors of a planning decision (details supplied); and if he will make a statement on the matter. [25197/02]

Article 31 of the Planning and Development Regulations, 2001, provides that notification of a decision on a planning application must be given within three working days of the day of the decision to the applicant for permission and to any other person or body who made a submission or observation to the authority in relation to the application. Responsibility for ensuring compliance with this requirement, in individual cases, is a matter for the relevant planning authority. The provision is designed to ensure that objectors are made aware of decisions taken and given an opportunity to appeal to An Bord Pleanála. The redress open to any objector who has not been notified of a decision would be a matter for determination by the courts.
