Question:

375 Mr. N. O'Keeffe asked the Minister for Justice, Equality and Law Reform the terms of a contract in respect of a person (details supplied) in County Cork; and if this person is entitled to continue their position of employment until the age of 70 years as previously advised. [25425/02]

The person to whom the Deputy refers was employed as a non established civil servant.

Non established civil servants retire on reaching 65 years of age. However, their retention can be sought provided they qualify on certain grounds, the guidelines for which are set by the Minister for Finance. These are either on grounds of hardship, in the public interest or for the purpose of increasing their pension, lump sum or gratuity.

Unfortunately, the person referred to did not satisfy the criteria for retention on any of these grounds. The applicant's legal representative has been notified in writing of my decision.
