Question:

132 Mr. M. Higgins asked the Minister for Communications, Marine and Natural Resources if he has received a submission from RTE on the losses to RTE arising from the corrupt action of the former Minister described in the second interim report of the Tribunal of Inquiry into Certain Planning Matters and Payments; if a decision has been made to compensate for the losses arising from the Minister's action; and if he will make a statement on the matter. [1809/03]

I refer the Deputy to my answers to Question No. 92 of 9 October 2002 and Question No. 131 of 19 November 2002. In the context of the licence fee application my Department made it clear to RTE that the Department was open to RTE raising any particular concern it has relating to commercial and other operational constraints in the context of its licence fee application. I can confirm that I have not received a submission from RTE of the nature described in the question.
